Marxismo y derecho en América Latina o El primer Correas: Marxism and Law on Latin America or The first Correas

Resumen

La crítica de la economía política que inauguro Marx, es el método por excelencia para analizar a la sociedad capitalista. Fue utilizado por infinidad de científicos sociales para entender las contradicciones que se presentan y para tratar proponer soluciones. Para el caso de América Latina se dieron enormes reflexiones que explicaban a nuestra región y sus problemas específicos, no obstante, los estudios sobre el derecho se vieron abandonados por los intelectuales, esta situación, por supuesto incluyo a los marxistas. Fue hasta que apareció el jurista Oscar Correas que llenó este vacío. Fue el primero en tratar de dar una explicación totalizadora desde Marx a la forma jurídica. Al pasar los años, sus reflexiones tomaron otros matices, mostrando tensiones entre diferentes conceptos y posiciones que el autor había sostenido. Sin embargo, ese “Primer Correas” de la década de 1970 a finales de los 80´, en el cual nos centraremos en este trabajo, dejó una ruta marcada que es imprescindible retomar para entender y superar la crisis de la forma jurídica capitalista.

Abstract

The critique of the political economy inaugurated by Marx, is the quintessential method for analyzing capitalist society. It was used by countless social scientists to understand the existing contradictions and their possible solutions. In the case of Latin America, there were enormous reflections that explained our region and its specific problems. However, legal studies were abandoned by intellectuals, including marxists. It was until the jurist Oscar Correas appeared that this void was filled. He was the first to try to give an explanation of the totality of legal form based on Marx´s thinking. Over the years, his reflections took on nuances that generated tensions between different concepts and positions that the author had sustained. However, that “First Correas” of the 1970 until the end of 1980, in wich we focus on this work, left a path that is essential to recover to understand and overcome the crisis of the capitalist legal form.
